Terms of Service

Last updated: 2026-07-18. These Terms of Service (“Terms”) govern access to https://x70.one, https://app.x70.one, and the web design, setup, hosting, and portal services offered by Daniel Ensminger, trading as x70 (“x70”, “we”, “us”).

1. Agreement

By browsing this website, requesting a proposal, accepting a claim invite, creating an account, or purchasing services, you agree to these Terms and our Privacy Policy. If you act on behalf of a business, you confirm you are authorized to bind that business.

2. Services

Depending on your order, services may include:

Design adaptation and setup of a website based on a pre-built or custom prototype
Managed edge hosting, SSL, domain mapping, and related maintenance
Access to the x70 Client Portal for change requests, billing, and account management
Optional add-ons described in a written proposal or invoice

Published pricing (for example setup from €350 and Managed Edge Care at €39/month) is indicative unless confirmed in a proposal, checkout session, or written agreement. Custom quotes control when they differ from the public pricing page.

3. Accounts and portal access

You must provide accurate registration information and keep credentials secure. You are responsible for activity under your account and organization. We may suspend access for unpaid invoices, abuse, or security risk.

4. Fees, billing, and subscriptions

Setup fees are one-time charges for the agreed onboarding and launch work, payable as stated at checkout or in your proposal.
Monthly maintenance / Managed Edge Care is a recurring subscription billed via Stripe until cancelled according to these Terms or your plan settings.
Prices are in EUR unless stated otherwise and may be subject to applicable VAT (Umsatzsteuer) based on your location and status.
Failed payments may result in suspension of hosting or portal access after reasonable notice.

5. Cancellation and termination

You may cancel a monthly subscription via the Stripe Customer Portal or by emailing contact@x70.one. Cancellation takes effect at the end of the current paid billing period unless otherwise agreed. Setup fees are generally non-refundable once work has started, except where mandatory consumer law requires otherwise or we agree in writing.

We may terminate or suspend services for material breach, prolonged non-payment, or unlawful use. Upon termination we may take the site offline; we can discuss export of content on request.

6. Consumer withdrawal (EU/EEA)

If you are a consumer (Verbraucher) in the EU/EEA concluding a distance contract, you may have a 14-day right of withdrawal under statutory rules. For digital content or services that begin during the withdrawal period with your express prior consent and acknowledgment that you lose the right of withdrawal once performance has begun, that statutory exception may apply. Business customers (Unternehmer) typically do not have a statutory consumer withdrawal right. Contact us before purchase if you need clarification for your situation.

7. Client content and responsibilities

You retain ownership of materials you supply (logos, photos, copy). You grant us a licence to use them to deliver the services. You warrant that you have the rights to provide that content and that it does not infringe third-party rights or applicable law. You are responsible for the accuracy of business information published on your site.

8. Intellectual property

Unless otherwise agreed in writing, we retain intellectual property in our frameworks, components, design systems, and tooling. Upon full payment of the agreed setup fee, you receive a licence to use the delivered website for your business. Proposal mockups and unpublished work remain our property until paid and accepted as agreed.

9. Change requests

Subscription plans may include a defined allowance of content or design change requests via the portal. Requests outside the plan scope, or that require new custom engineering, may be quoted separately. We aim to respond promptly but do not guarantee same-day turnaround unless expressly agreed.

10. Availability and third-party services

Hosting depends on third-party infrastructure (including Vercel and related providers). We strive for high availability but do not guarantee uninterrupted uptime. Scheduled maintenance and provider-side incidents may affect availability.

11. Disclaimer

Except where mandatory law provides otherwise, services and website content are provided on an “as is” and “as available” basis. We do not warrant that the site or portal will be error-free or that results (including SEO rankings or business outcomes) are guaranteed.

12. Liability

Nothing in these Terms limits liability for intent (Vorsatz), gross negligence (grobe Fahrlässigkeit), injury to life, body, or health, fraud, or other liability that cannot be limited under German law, including under the Product Liability Act where applicable.

For slight negligence, we are liable only for breach of essential contractual obligations (Kardinalpflichten), and liability is limited to the typical, foreseeable damage. For paid services, our aggregate liability in any 12-month period is limited to the fees you paid us for the affected service in that period, except for the mandatory cases above.

13. Acceptable use

You may not misuse the website or portal, attempt unauthorized access, interfere with security, scrape at abusive volumes, or use the services for unlawful content or spam.

14. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules. Mandatory consumer protections in your country of residence remain unaffected. Courts in Germany have jurisdiction, subject to mandatory consumer venue rules.

15. Changes

We may update these Terms. The “Last updated” date will change when we do. Continued use after changes take effect constitutes acceptance, except where your explicit consent is required.
